We didn't sign anything until the last record. But the contract encompassed everything. How do you sign something like this? Well I don't know how many contracts you've signed lately but they can be a little confusing. Tim just kept telling us it was very standard and that he was only trying to help us out. Now I know a lot you don't wanna beleive this about a guy who makes such a great mixed tape, but if this chaps your hide wait till you see the new RS t-shirt that just says Tim Warren is a crook.

I can understand not reading the small print when you sign something drawn up by a person who you think is a friend. What did he say when he asked you to sign something at such a late stage? Pretty strange, really.

little confusing??? it's your future man, you don't play with you future, all contracts are confusing and tend to be better for the people who writes it, thats why you never sign anything without giving it a littel thought, he could be a crook, but look to me that you were pretty naive and dumb, it's your foult to sigh such a thing, you should put in the back of that t'shirt "and I was so dumb".

Tim sends this same weak ass smoke screen everytime I bring it up. This is not a fucking accounting of records sold people. This is his fucking make beleive spread sheet of what I'm supposed to accept. This was not nor has anything he has sent me in the past been prepaired by an accountant for my approval. The whole music industry is built on the fact that musicians or artists don't know anything about accounting!
It seems to me that alot of labels use the "you didn't sell anything" story to discourage bands and/or musicians from feeling like they're worth anything. If they can get you to believe that you really didn't sell any records, then there is much less of a chance you'll go get a lawyer, since winning your royalties wouldn't amount to enough.
Of course, watching a person's self esteem twirl down the toilet is not half as bad as paying him what you owe him!

Mastering costs are almost always considered a recording cost and charged against the bands' royalties, even if the label owns the masters. So it's not sleazy/uncommon for a lable to charge you for mastering your own record. Labels don't pay for the recordings, and then not own them. It's a different situation if the band pays for recording/mastering themselves -- then usually the band will license the record to the label for a set number of years.

I think the "renewed interest" is just the same amount of hip kids who were into those bands when they existed. The number was small then, as it is now, but the tendency is that as the "legend" grows, it gives the impression that there's a commensurate jump in record sales and I wonder if that's realistic.

ed ob -- ok I'll try to be clearer. Of course I'm not saying the people who bought the records in 94 are repurchasing. What I'm saying is that I don't think there's a GREAT many more kids buying oblivians records in 2004 as when the band existed. I'm sure that's not the case in Memphis but Memphis isn't representative of the country. All I'm saying is that to someone who follows the music closely, as people in this forum do, I think there's a tendency to think Oblivians/Gories/Beguiled move alot more records than they actually do, b/c those bands are so (rightfully) revered now. I think the people who were in those bands are even more convinced of that, which isn't necesarily from any ego-tripping, but just the result of hearing over and over how good/influential your band was. Obviously I can't comment on the validity of the claims of Tim or you since very few people know enough details to offer any meaningful comment. And sorry, this isn't Tim.

you can find the soul food cd or lp in ebay for less than 5 dollars and nobody bids for.
At my store in 5 years nobody told me "I am replaceing my copy of soul food, I wear out my old copy" I never heard of that.
Bazooka Joe that play the shit of the Oblivians records, I don't think he ever bought another copy to replace a the record.
and if you want to buy an Oblivians record in New york, with their 8 million people or more, I don't think there is another record store besides mine where you can find it.
in 2002 I made $48.00 profit selling Oblivians records, in a whole fuching year. And your latest release the live in atlanta I sold 5 LP and 3 Cd so far since it got out.
Greg all that mean shit you said about Tim is tasteless maybe we can dig and find out how many kids you have with defernt gils, or why you close your record store, or why you couldn't keep your band together, and so on, do you think thats gonna fix anything? at the end Goubler is gonna be right about you.

Hmmm.. looking at the figures from the sales spreadsheet, if the (seemingly low) sales figures are correct-assuming the albums sold approx. the same amnt each year since '97 that should make about 4000 lp + cd in the last 6 years. Logically, that would about $8000 that should be paid to the band, but nothing paid since '97. What's the deal with that?
Anyway Crypt puts out great records and so do all the Oblivians that's the only thing that's for sure. Can you tell i'm bored at work?

That stuff about ebay is way off: my CD of Popular Favorites got stolen awhile back and two weeks ago I saw a very cheap copy on ebay I thought I'd be able to pick up to replace it. By the time everything was said and done, the final bid price was as high as it would be to score a brand new copy. People definitely want the stuff.

for sparsly attended show.
9/11/94 -bought 12 pack of beer at circle K. split the rest and got drunk after deducting 69cents from Jack's money for the SlimJim beef stick we purchased on his behalf.

Ok, I've bought at least 2 copies on CD of each of those recordings (I'm hard on CDs) and one LP. All new and mostly from Shake-It Records here in Cincinnati. Circle Records, Everybody's Records, and multiple other stores here in Cincinnati stock the ENTIIRE CATALOG. I guess they keep a lot of records around that they don't sell. I guess I'll just download the MP3s for all the Crypt releases now and make my own CDs, as it appears that's pretty much what's going on anyway. This is just despicable...

I had a friend who called Tim Warren at Crypt in Columbus too get what he said was the last copy of Sore Loosers...and Tim was drunk and like, my friend had to keep sending him letters reminding him that he had forgot to send it before he ever did get it. I figured enough shit was being thrown at Ed, that little antetdote was justified...doesn't realy mean anything thow.

As for The Oblivians records....I know that here in my town, as of 2003 there was at least 3 record stores where you could pick up Oblivians records....but I live in a town where there's nothin to do but collect records.

It's kind of tough to maintain a nuetral stance, but I will say that the stuff Ed Oblivian is bitching about, is a pretty common senerio...Anyway Lightnin Hopkins who put more shit down on tape than any other blues singer hardly ever saw any royalties.....people said he just wasn't selling....alot of older blues guys got ripped off because record execs blamed poor sales on the Depression, they tried to do that like up untill the 60s! When there was a goddamn folk blues revival happening and the Depression had been over for 30 years.

I'm just saying that I'll put out people records if they want....you pay for the recording, you pay for the pressing, you handle distributing, you put the name of my record label on the back, and you collect all the god damn profits and royalties....you get to be associated with me, and you keep all the money...It's a win win for both of us.

I confess, I patronize Virgin... I live on 46th street. The Virgin Megastore in Time Square is at the corner of 46th and 7th. They usually have Oblivians CDs in stock. I’m there somewhat regularly due to convenience. I look to see what’s there and for my own curiosity, I look to see what’s moving. Sometimes the Oblivians bin is stocked and sometimes it is empty. Someone is buying them. It does claim to be the largest record store in the world, so their numbers obviously won’t be representative of other retail outlets, but the mere fact that they carry them and they are sometimes out of them is enough anecdotal evidence to convince me that you probably are getting screwed.

I also know for a fact that at least some Tower Records stores stock Oblivians CDs. I don’t know how broadly they distribute them across their national chain, and I’m not in their nearest location often enough to know whether they see much turn over, but they definitely carry them. The location on Broadway at Lincoln Center had a fat stack of Oblivians CDs last I was in there (probably around the holidays). They also keep the Jack Oblivian solo stuff filed with the band’s CDs.

I’m throwing my two cents in here mostly because I’ve always been amazed at what great distribution the Oblivians have. From my observation, every major chain in the city carries your CDs. I was not aware that you had signed your ownership away.

1) Exactly how is Ed supposed to challenge Warren over the amounts sold, apart from ringing every indie record store / distributor in the world?

2) Every indie and chain rekkid store I've been in over the past decade has stocked Oblivians on vinyl and/or CD - and they do seem to be moving.

3) If Warren is claiming that only a few hundred Oblivians discs got sold during '94 [whoops, I mean '04!], then how come Ed has seen different pressings? Even Warren can't afford to press less than 500 LPs or CDs a pop, especially the vinyl ...

4) As Bill Hicks once pointed out, vis-a-vis the difference between the Republicans and the Democrats, do you want to be fucked-over by someone who tells you that they love you, or someone who tells you that they're gonna fuck you over?
