If someone got you to sign something that said they own your recordings and your publishing forever, and on top of that they never paid you, you'd probably feel the same. Maybe not.I'm just clearing up the lyrics to a song. Could be wrong, Haven't listened to it in a while.

'time was in a vacuum and I wanted to be free...'

Not wishing to sound contentious, but why then did the band go on to do more records with Crypt? It certainly sounds like a bum deal. Or am I missing the irony here?

We didn't sign anything until the last record. But the contract encompassed everything. How do you sign something like this? Well I don't know how many contracts you've signed lately but they can be a little confusing. Tim just kept telling us it was very standard and that he was only trying to help us out. Now I know a lot you don't wanna beleive this about a guy who makes such a great mixed tape, but if this chaps your hide wait till you see the new RS t-shirt that just says Tim Warren is a crook.

I can understand not reading the small print when you sign something drawn up by a person who you think is a friend. What did he say when he asked you to sign something at such a late stage? Pretty strange, really.

I look forward to buying a shirt on your next Euro tour- that is, of course, if you're coming to the UK this time. Will you make it here this time? Let me know if you need tour help.

little confusing??? it's your future man, you don't play with you future, all contracts are confusing and tend to be better for the people who writes it, thats why you never sign anything without giving it a littel thought, he could be a crook, but look to me that you were pretty naive and dumb, it's your foult to sigh such a thing, you should put in the back of that t'shirt "and I was so dumb".
and I still don't believe that you didn't get a penny out of it.
one more thing in this bussines they are all crook, but as everything there good crooks and bad crooks.

PLUS approximately 19,000 DM in GEMA (German Mechanical (songwriter)) fees that are wired by GEMA to the songwriters direct.

So... of the 39,000 DM (approx $23,000) we paid in advances and Gema, there are only deductions of approx 4677 DM in Mastering fees & 1287 DM in video & UK promo fees, and that leaves approx 33,000 DM the band earned from European sales.

Take note of no further deductions in a fuckload of adverts and promo, tour booking, etc.

Of the $14,615.69 Crypt USA paid in Merch & $$ advances, there is only approximately $500 in mastering fees, $750 in promo costs, $645 in video fees.

Take note of no further deductions in a fuckload of adverts and promo, etc.

The FIRST contract we did with you was for 2 albums ("Soul Food", then "Pop Faves".)
The SECOND was for 2 more albums, of which we got One ("Play 9 Songs..") and then you broke up the band.

Publishing: We did a publishing deal with you ONLY for Europe, for a 5-year term, renewable for more 5-year terms at BAND's OPTION. Give me a break with this addled crap about us STEALING your publishing.

Tim sends this same weak ass smoke screen everytime I bring it up. This is not a fucking accounting of records sold people. This is his fucking make beleive spread sheet of what I'm supposed to accept. This was not nor has anything he has sent me in the past been prepaired by an accountant for my approval. Something his contract said I was to receive every six months.Try once every 3 years and like Tim said himself it always says the same damn thing. They don't sell. Yeah Mike, you think this is better than Long Gone's deal? He at least has the fucking courtesy of letting you know up front he has no entention of paying you anything else! Tim's phoney spread sheets useta boggle my mind as well. It's there in black & white , must be true. Why do you people think this fucker has moved so many times in the last 10 years, why has he changed distributors so many times. Makes for a big ass mess. You can throw bullshit lists of numbers at me and everybody else all day what it comes down to motherfucker is you haven't paid me anything in YEARS!!!!! That shit sells that bad for ya huh? Then just hand the fucking masters back to us and tend to your fucking bootleg series (sorry, you probably tell everybody you pay the people on back from the grave comps too right?)You beleive your own bullshit, all hustlers do. I owned a fucking record store Tim! I've seen at least three different pressings of our records in the last two years! What am I supposed to beleive? You press them in bathches of a hundred you lying sack of shit? Am I supposed to beleive that with the renewed interest in bands like oblivians and the gories that poor old Tim can hardly give this shit away?As for making an ass of myself in a public forum I could give a shit. I know whos telling the truth. And you've done your share of shit talking Tim. Plus what are you gonna do sue me for slander? A guy who makes bootleg records for a living is gonna sue me for slander? Tims post could be reduced to" nothing to see here folks". Well don't beleive it. Yea, I'm at fault for trusting him. I thought the guy was our freind. I like the mastering fees up there. Thats a laugh! I'm charged fees for masters that belong to you. Why don't you send me the fucking bill the next time you have your car worked on while you're at it. Advertising? Are you talking about those ads you run with your whole fucking catalogue printed in them? You could wear 8 pairs of sunglasses but I see straight through you.

The whole music industry is built on the fact that musicians or artists don't know anything about accounting!
It seems to me that alot of labels use the "you didn't sell anything" story to discourage bands and/or musicians from feeling like they're worth anything. If they can get you to believe that you really didn't sell any records, then there is much less of a chance you'll go get a lawyer, since winning your royalties wouldn't amount to enough.
Of course, watching a person's self esteem twirl down the toilet is not half as bad as paying him what you owe him!

Geez Greg, I was just making light of the situation that Long Gone's deal isn't really any better. At least you know he's putting out YOUR records. He still won't put out any of my records if that makes you feel any better. Probably doesn't though.
Can't wait to see you & jack in NY!

Mastering costs are almost always considered a recording cost and charged against the bands' royalties, even if the label owns the masters. So it's not sleazy/uncommon for a lable to charge you for mastering your own record. Labels don't pay for the recordings, and then not own them. It's a different situation if the band pays for recording/mastering themselves -- then usually the band will license the record to the label for a set number of years.

I think the "renewed interest" is just the same amount of hip kids who were into those bands when they existed. The number was small then, as it is now, but the tendency is that as the "legend" grows, it gives the impression that there's a commensurate jump in record sales and I wonder if that's realistic.

I know your not gonna give'em back. How bout I buy'em off ya for what you got in'em? Let's see, I know Eric paid for Soul Food out of his own pocket. Less than $600.00 I think. Go ahead and figure in what the others cost. Either way it won't top six grand. Then I'll throw in another 4 grand. You'll be rid of these proffitless musty-dusties forever. Geez 7 years old. Hey godisgreat, last time I checked those hip kids were a good 10 years older. Definitely not the 18 year old white belt wearin' kids who bought'em in my store. I don't understand, you think the same people keep buying the records? Now I see, that grand total of 78 soul food CD's Tim claims to have sold in 2002,WHOAH!!! Let me repeat 78 copies for the whole fucking year. Your saying the hipsters from 94 were just replacing their beat-up copies. Wow Ti... I mean godisgreat. You really fucking cleared it all up.

ed ob -- ok I'll try to be clearer. Of course I'm not saying the people who bought the records in 94 are repurchasing. What I'm saying is that I don't think there's a GREAT many more kids buying oblivians records in 2004 as when the band existed. I'm sure that's not the case in Memphis but Memphis isn't representative of the country. All I'm saying is that to someone who follows the music closely, as people in this forum do, I think there's a tendency to think Oblivians/Gories/Beguiled move alot more records than they actually do, b/c those bands are so (rightfully) revered now. I think the people who were in those bands are even more convinced of that, which isn't necesarily from any ego-tripping, but just the result of hearing over and over how good/influential your band was. Obviously I can't comment on the validity of the claims of Tim or you since very few people know enough details to offer any meaningful comment. And sorry, this isn't Tim.

you can find the soul food cd or lp in ebay for less than 5 dollars and nobody bids for.
At my store in 5 years nobody told me "I am replaceing my copy of soul food, I wear out my old copy" I never heard of that.
Bazooka Joe that play the shit of the Oblivians records, I don't think he ever bought another copy to replace a the record.
and if you want to buy an Oblivians record in New york, with their 8 million people or more, I don't think there is another record store besides mine where you can find it.
in 2002 I made $48.00 profit selling Oblivians records, in a whole fuching year. And your latest release the live in atlanta I sold 5 LP and 3 Cd so far since it got out.
Greg all that mean shit you said about Tim is tasteless maybe we can dig and find out how many kids you have with defernt gils, or why you close your record store, or why you couldn't keep your band together, and so on, do you think thats gonna fix anything? at the end Goubler is gonna be right about you.

And go ahead and dig asshole you won't find out anything about me everybody here doesn't know. That said, You are the biggest ass licking flunky I have come across in a while. When I first told you I had problems with Tim about 2 years ago. Your reply was "but Tim make you famous. If not for his label nobody know who you are at all." Sorry man but I'm sticking with the idea that people like those records for the music. Being Tim's little protege' is such a badge of honor for you it's practically written on your fucking forhead. As for Goubler, we don't like each other but at least the fucker never stole from me. Bad stuff I said about your hero: he hasn't paid me, he wears sunglasses all the time cause he's got beedy eyes, the reason his sales are so poor is he always moves his operation or switches distributors, he's a hustler, he got me to sign a bad contract, the majority of his catalogue is bootlegs,he has never sent me an accounting prepared by an accountant. I stand by all of these. I tried to end this thread croney, so fuck off back to you're store now.

Time was in a vacuum, when I wanted to be free.
But now my adolescence has all but left me.
I could have stayed another day, but it would be wrong.
And you would just grow tired of me, before too long.

I say no. I must go.
I’m not the one you want, though I know you think so.
I’m a bad man. (x4)
But I’m…
Too good for you…
My Suzie, true.

Time was an obsession, but that was just for me.
You can tell by the sound of my shoes that I am gonna leave.
Even if you plead with me, and say you were so true.
It’s too late for long goodbyes…Honey, we are through.

Wow this is awesome, just like Math class! Hmmm.. looking at the figures from the sales spreadsheet, if the (seemingly low) sales figures are correct-assuming the albums sold approx. the same amnt each year since '97 that should make about 4000 lp + cd in the last 6 years. Logically, that would about $8000 that should be paid to the band, but nothing paid since '97. What's the deal with that?
Anyway Crypt puts out great records and so do all the Oblivians that's the only thing that's for sure. Can you tell i'm bored at work?

That stuff about ebay is way off: my CD of Popular Favorites got stolen awhile back and two weeks ago I saw a very cheap copy on ebay I thought I'd be able to pick up to replace it. By the time everything was said and done, the final bid price was as high as it would be to score a brand new copy. People definitely want the stuff.

Oblivians always split money equally. No big story there. Here's a snipet from my official financial files though.
9/10/94 -received $23.00 from Antenna
for sparsly attended show.
9/11/94 -bought 12 pack of beer at circle K. split the rest and got drunk after deducting 69cents from Jack's money for the SlimJim beef stick we purchased on his behalf.
Of course this could go on and on all day so I'll spare you. Man this box of financial data is so heavy! Wish this was radio. I could make sounds like I was walking them back up the creeky old stairs to the attic.

Ok, I've bought at least 2 copies on CD of each of those recordings (I'm hard on CDs) and one LP. All new and mostly from Shake-It Records here in Cincinnati. Circle Records, Everybody's Records, and multiple other stores here in Cincinnati stock the ENTIIRE CATALOG. I guess they keep a lot of records around that they don't sell. I guess I'll just download the MP3s for all the Crypt releases now and make my own CDs, as it appears that's pretty much what's going on anyway. This is just despicable...

I had a friend who called Tim Warren at Crypt in Columbus too get what he said was the last copy of Sore Loosers...and Tim was drunk and like, my friend had to keep sending him letters reminding him that he had forgot to send it before he ever did get it. I figured enough shit was being thrown at Ed, that little antetdote was justified...doesn't realy mean anything thow.

As for The Oblivians records....I know that here in my town, as of 2003 there was at least 3 record stores where you could pick up Oblivians records....but I live in a town where there's nothin to do but collect records.

It's kind of tough to maintain a nuetral stance, but I will say that the stuff Ed Oblivian is bitching about, is a pretty common senerio...Anyway Lightnin Hopkins who put more shit down on tape than any other blues singer hardly ever saw any royalties.....people said he just wasn't selling....alot of older blues guys got ripped off because record execs blamed poor sales on the Depression, they tried to do that like up untill the 60s! When there was a goddamn folk blues revival happening and the Depression had been over for 30 years.

I'm just saying that I'll put out people records if they want....you pay for the recording, you pay for the pressing, you handle distributing, you put the name of my record label on the back, and you collect all the god damn profits and royalties....you get to be associated with me, and you keep all the money...It's a win win for both of us.

I say no, I must go, I'm not the one you want though I know you think so I'm a bad man(3) and I'm no good for you. My Suzie true. You can tell by the sound of my feet that I am goona leave. And even if you begged to me. If you got down on your knees. (1)I never would have held your hand so tight to make you stay. If I had known that your sweet hand was going to pull away...or..(2)even if you plead to me, and say you was untrue. It's too late for long goodbyes. Now we are through.(chorus) the tip top version predates the oblivians version by about a year. at the time we cut it with the oblivians I could not remember the last line and came up with an alternate line while we recorded. This will be further blurred by the fact that the Cobras changed lines as well. But I do tend to adlib everything live.

For this, I can speak for a fact that this asshole couldn’t be more full of shit.

I confess, I patronize Virgin... I live on 46th street. The Virgin Megastore in Time Square is at the corner of 46th and 7th. They usually have Oblivians CDs in stock. I’m there somewhat regularly due to convenience. I look to see what’s there and for my own curiosity, I look to see what’s moving. Sometimes the Oblivians bin is stocked and sometimes it is empty. Someone is buying them. It does claim to be the largest record store in the world, so their numbers obviously won’t be representative of other retail outlets, but the mere fact that they carry them and they are sometimes out of them is enough anecdotal evidence to convince me that you probably are getting screwed.

I also know for a fact that at least some Tower Records stores stock Oblivians CDs. I don’t know how broadly they distribute them across their national chain, and I’m not in their nearest location often enough to know whether they see much turn over, but they definitely carry them. The location on Broadway at Lincoln Center had a fat stack of Oblivians CDs last I was in there (probably around the holidays). They also keep the Jack Oblivian solo stuff filed with the band’s CDs.

I’m throwing my two cents in here mostly because I’ve always been amazed at what great distribution the Oblivians have. From my observation, every major chain in the city carries your CDs. I was not aware that you had signed your ownership away.

For my two-pennorth ...

1) Exactly how is Ed supposed to challenge Warren over the amounts sold, apart from ringing every indie record store / distributor in the world?

2) Every indie and chain rekkid store I've been in over the past decade has stocked Oblivians on vinyl and/or CD - and they do seem to be moving.

3) If Warren is claiming that only a few hundred Oblivians discs got sold during '94 [whoops, I mean '04!], then how come Ed has seen different pressings? Even Warren can't afford to press less than 500 LPs or CDs a pop, especially the vinyl ...

4) As Bill Hicks once pointed out, vis-a-vis the difference between the Republicans and the Democrats, do you want to be fucked-over by someone who tells you that they love you, or someone who tells you that they're gonna fuck you over? Apart from the 'Stripes, I ain't never seen any complaints against LGJ ...

People like us have to rely on trust, cos we cain'ts afford lawyers ... Unfortunately, there's a lotta folks who can ...

In an ideal scenario, Warren should've been shamed into returning the masters, but I reckon he won't ... I don't blame Ed for losing it, he's got every right ...

Feelin' So Good (S.K.O.O.B.Y.-D.O.O.)
By: The Archies
(Jeff Barry & Andy Kim)
1969

Bow bow whompa bow bow
Doo doo doo
Bow bow whompa bow bow
Doo doo doo
Bow bow whompa bow bow
Doo doo doo

Looky over there, sunshine in her hair
That's my girl; her name is Skooby-Doo
Don't you like her smile?
Don't you like her style?
You know I'd walk a mile for Skooby-Doo

Oh my Skooby-Doo
I do what you want me to
Oh my Skooby-Doo
You got my only head a-reeling all the time
Feelin' so good
(So good)
Feelin' so good

Anytime at all I wanna have a ball
All I do is call my Skooby-Doo
She can make me laugh in a minute and a half
Yes, I'm going daff with Skooby-Doo

Oh my Skooby-Doo
I do what you want me to
Oh my Skooby-Doo
You got my only head a-reeling all the time
Feelin' so good
(So good)
Feelin' so good

Oh my I love you
Skooby-Doo, I love you
I said a "S"
"K"
"O-O"
"B"
"Y"
"D-O-O"
oh oh
oh oh
oh
oh
oh oh oh oh

Diamonds and a ring, presents I could bring
Wouldn't mean a thing to Skooby-Doo
Sunday after mass picnic in the grass
Diggin' Mama Cass with Skooby-Doo

Oh my Skooby-Doo
I do what you want me to
Oh my Skooby-Doo
You got my only head a-reeling all the time
Feelin' so good
(So good)
Feelin' so good
(So good)
Feelin' so good

Whompa bow bow
Whompa bow bow
Whompa bow bow my Skooby-doo
(Feelin' so good)

Whompa bow bow
(So good)
Whompa bow bow
(Feelin’ so good)

Whompa bow bow my Skooby-doo

Whompa bow bow
Whompa bow bow
Whompa bow bow my Skooby-doo

(Feelin’ so good)

Wow, I tripped on these forums because its the first place I found the assumed lyrics to bad man. I don't know what is more the ultimate rock and roll behavior...me googling "time was in a vaccum" or you people talking miles and miles of shit on a message board to some spainish dude who just wanted to know what a great song was about. What would keef do? I bet he would go to the 'crazy rock and roll party' folder on the ipod and tear me a new asshole with his wireless keyboard. Do they make black and white striped mousepads?

Can someone hook me up with bands or DJ's that would like to play live on Saturday nights outside in Downtown Memphis in Front of Memphis' only 5 Star Florist- SharpFlowers at The Peabody Place Trolley stop next to BlueFin and Swig?

Spits got shafted by nickel and dime so they booted the 1st cd up on wax and sold it at shows for $20, now it goes heavy on ebay.

Italy used to sell boot recordings like crazy

Wait! So members of Modest Mouse formed a garage band with "garage instruments" to cover Oblivians "Bad Man" and wear stupid woven hats? Can I just say, fuck that shit!
